Overview

This End User License Agreement is provided by creativemark.org (henceforth called, CreativeMark).

When you purchase a Product from CreativeMark, you're actually purchasing a license to use that Product. So it's important to understand the conditions of your license.

CreativeMark offers the following end user licenses (Basic and Extended), both of which can be used to create any type of End Product for personal or commercial use.

You are licensed to use our Product to create one or more End Products depending on the license.

Restrictions

Limitations to the license include:

• You cannot purchase any of our Products and sell or redistribute that Product "as is" or with slight modifications to other marketing websites as a competing product.
• No CreativeMark source code or Product material can be submitted to the general public (such as open source projects).
• If our Product is being used for 'on demand' website builders or app generators, a separate license is required for each End Product.
• None of our Products can be redistributed or resold without meeting the conditions of our End Product definition (see below).

License Period

There is no termination period to any of our licenses. This means that once you purchase a license to any of our Products, you can continue to use that Product for as long as you wish. That being said, the continued use thereof must adhere to the restrictions outlined in this document.

Breach of License

This license can be terminated if you breach it. If that happens, you must stop making copies of or distributing the End Product until you remove the all of our Items from it.

General

Our source code can be completely changed based upon your requirements. Note also that our Products also incorporate many free, open source libraries. If you need documentation or source code for any of these libraries, go to that libraries website.

Legal Agreement

By purchasing and using any of our Products, you agree to the following:

• That this End User User License Agreement (EULA) is a legally binding and valid contract.
• That you are legally bound by this End User License Agreement (EULA).
• That you will abide by the intellectual property laws and all of the terms and conditions stated in this End User License Agreement.

If you do not agree to be bound by this agreement, please do the following:

• Remove all of our Items from you computers and/or servers.
• Return by email any copies of our Items that you have in your possession to admin@CreativeMark.com.

Licenses

All of our licenses work in conjunction with the following documents:

• Terms of Service
• Terms of Use
• End User License Agreement

If there are any discrepancies between any of our licenses and any of the documents listed above, the license will take precedence.

Definition of Terms

• Item - is any digital material or Product created by CreativeMark that is made available to the Person following a purchase of any of our licensed Products.
• Product - is any digital material or Product created by CreativeMark that is made available to the Person following a purchase of any of our licensed Products.
• Person is the individual who has purchased any of our licensed Products.
• Client is an individual or company that receives services, or End Product from the Person.
• End Product is defined as a single application ...
  • that is produced from, or incorporates any Product whether in part or in whole, made available to the Person upon purchase.
  • that is a customized implementation of our Product based on your content and product requirements.
  • whose customization is different in nature than our purchased Product.
  • whose customization is not used to create any another form of competing product such as a Template or UI Kit.

Basic License

• The Basic License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the digital work (Item) you have purchased.
• You are licensed to use the Item to create one single End Product for yourself or for one Client.
• The End Product can be sold or distributed free of charge.
• Your cannot re-distribute the Item or any of its digital material in a competing tool or template.
• You cannot re-distribute or make the Item available as-is or with minor modifications.
• Your license can be terminated if you violate it.
• Should your license be terminated, you are required to stop making copies of and/or distributing the End Product until you remove the Item from it.
• CreativeMark retains ownership of the Item but grants you the license under the terms outlined herein.
• This license is between you and CreativeMark.

Extended License

• The Extended License grants you, the purchaser, an ongoing, non-exclusive, worldwide license to make use of the digital work (Item) you have purchased.
• You are licensed to use the Item to create multiple End Products for yourself or for your Clients.
• The End Product can be sold or distributed free of charge.
• Your cannot re-distribute the Item or any of its digital material in a competing tool or template.
• You cannot re-distribute or make the Item available as-is or with minor modifications.
• Your license can be terminated if you violate it.
• Should your license be terminated, you are required to stop making copies of and/or distributing the End Product until you remove the Item from it.
• CreativeMark retains ownership of the Item but grants you the license under the terms outlined herein.
• This license is between you and CreativeMark.
